PRELIMINARY CONTRACT FOR
PURCHASE-SELLING OF A REAL ESTATE


Today, ..................... 200… in the City of Sofia, the present contract was signed under the art. 19 of the Law for Obligations and Contracts between the following parties:
1. ..................... with ID № ....................., personal card №....................., issued on ....................., by ....................., city of ....................., hereinafter called BUYER, from the one side and on the other
2...................... with ID № .....................,
personal card №....................., issued on ....................., by ....................., city of ....................., hereinafter  called SELLER,
The present preliminary contract for purchase-selling of a real estate was concluded under the following terms:

I. SUBJECT OF THE CONTRACT:
1.1 The SELLER agrees to sell to the BUYER the following real estate, owned by him/her, and namely: .....................
1.2 The BUYER agrees to pay to the SELLER the contracted price, amounting to € ..................... (..................... Euro) for the above described real estate, which price shall be paid in the following way:
 - Earnest, amounting to €..................... (.....................Euro), which shall be paid in the moment of the signing the present contract
- the rest of the price of the real estate, amounting to €..................... (..................... Euro), in the moment of concluding the final contract.



II. TERMS OF THE CONTRACT:
2.1.  The contracting parties are  obliged to
conclude a final contract  - to avow the deal before a notary ....................., with permanent address: Sofia City, ....................., until latest date ..................... 200... and change in the contracted term can be done only in case of bilateral agreement, made in written way and annexed as inseparable part to the present contract.


III. RIGHT AND OBLIGATIONS OF THE SELLER
1.1.  The SELLER is obliged to present all
documents, necessary for the notary shaping of the deal, which documents also certify his/her right of ownership and are demanded by the law.
1.2.  The SELLER declares that he/she has never
transferred the real estate to other persons, that the real estate hasn’t got any burdens, bans, cannot be restituted and that there isn’t any juridical litigation in the moment.
3.3. The SELLER is obliged to pay off all obligations, connected to this real estate, to the moment of its notary transference (including fees for electricity, hot and cold water, heating, entrance fees etc.), as well as to sell the real estate free of any burdens and mortgages.
3.4.The SELLER is obliged to sell the real estate in the condition, described in art. 1.1. The real estate shall be vacated and its possession shall be transferred to the BUYER at the latest date .....................
3.5. In case of guilty dereliction of the articles of the present contract, or if it appears, that there is an acting decision of the court,  or some other preliminary contract with the same subject concluded, or that the real estate is a subject of juridical litigation, the SELLER owes the BUYER a penalty, amounting to the earnest doubled.

 

IV. RIGHTS AND OBLIGATIONS OF
THE BUYER:
4.1. The BUYER agrees to buy the real
estate, minutely described in art. 1.1 of the present contract, for the price and according to the terms of the same contract.
4.2. In case of guilty dereliction of the
articles of the present contract from the BUYER’s behalf, the earnest given stays for the SELLER.

V. OTHER TERMS:
5.1 The expenses for shaping the final contract (state and local fees), shall be paid in the following way: equally divided between both contracting parties.
5.2. Correspondence addresses between the contracting parties:

5.3 For any terms, which are not established by the present contract, the common decrees of the acting civic legislation shall be in force. The present contract can be proclaimed for final, basing on art. 19, paragraph 3 from the Law for Obligations and Contracts.

The present contract was concluded in two copies alike, one for each of the parties. The contract consists of 4 pages written in English and Bulgarian and the SELLER and the BUYER sign every page:
